Standard Terms and Conditions for Holiday Letting

The terms and conditions for the holiday letting as agreed to by both parties are as follows and also permits the owner or agent to refuse a key, amend the charge or immediately terminate the occupancy.

1. The premises are let to you for holiday purposes and only for the period stated on the receipt.
2. Photo ID. We require proof of identification for all bookings. A photocopy of the booking guests photo ID / Drivers licence is to be included with the return conformation documents.
3. All booking guests must leave a valid credit card number before time of check in as a security deposit, if the occupant cannot obtain a credit card they are required to leave a $200 bond as a security deposit. This will be refunded pending inspection after departure, approximately 14 days after departure.
4. The premises are available from 2:00pm on the day of arrival and are to be vacated by 9.30am on day of departure. Please return the keys to the agents office no later than 9.45am on the day of departure.
5. All payments are to be made in full 1 week prior to occupancy.
6. The deposit is 40% of the total tariff and is due within 14 days of making the booking. Where the full tariff is less than $350.00 the full tariff is the deposit amount. We cannot accept responsibility for any booking made without a deposit, as the booking will be deemed unconfirmed.
7. In the event of a cancelled booking by you, the deposit is not refundable if the cancellation is less then 10 weeks to the proposed arrival date and the full deposit held will be forfeited unless the premises are rebooked for the entire period, in which case a cancellation fee of $55.00 will be charged. Cancellations are to be in writing and are to arrive in our office 10 weeks prior to the proposed arrival date, if this is the case the deposit less the $55.00 cancellation fee will be refunded.
8. The booking is made in good faith by the agent but may be subject to any changes. All bookings are arranged for the dates shown on the receipt, having regards to the circumstances existing at the date of the receipt being issued. We reserve the right to cancel any booking should anything arise, which absolutely renders the booking impractical. In that event, we shall notify you as soon as possible and do our best to arrange alternative accommodation or dates suitable to you, failing which all deposit monies will be refunded, but no other claim, right of action or demand shall exist in or be made by either party.
9. The tariff is subject to change. The tariff may be increased at any time without notice.
10. Refunds of rent for cancellation of any part of the period reserved cannot be made under any circumstances. The full period originally reserved must be paid in full.
11. The numbers of occupants must not exceed the number stated on the confirmation documents, or the beds in the property, whichever is less. Overcrowding will render you liable for immediate termination of the booking.
12. All bed, bathroom and table linen must be provided by the occupants or hired locally through our office.(Blankets and/or doonas and pillows are provided).
13. Pets are not permitted on the premises. Strata management regulations are no animals of any kind are to be kept on the premises. (Unless authorised by agent)
14. All damage, breakages and losses to the property, furniture and furnishings, locks and key replacement or losses are to be reported to the agent and paid for immediately.
15. Garbage bins are to be put out and brought in on the specified collection day.
16. Occupants accept responsibility for blockages in any septic / drainage system.
17. No responsibility is taken for occupants' personal property left on the premises.
18. The description of the premises by the agent are made in good faith but no responsibility for misdescription can be accepted.
19. No person on the premises shall be guilty of conduct that is a nuisance to adjoining or neighbouring occupies. In home units Strata Title by-laws and regulations must be observed. Occupation of premises which in the absolute discretion of the agent causes nuisance or annoyance to adjoining or neighbouring occupies, will be TERMINATED forthwith.
20. You are required to allow repair and or service personnel to enter the premises for the purpose of conducting any repair or service deemed necessary by the agent. Such times of entering will be arranged prior where possible and unless in the opinion of the agent an emergency could exist or arise.
21. We reserve the right to enter the premises without notice and without prior arrangements in the absolute discretion of the agent.
22. In cases of apartments, units and villas car parking or carports are numbered, extra vehicles, boats etc are to be parked outside the grounds or other satisfactory arrangements are to be made with the agent.
23. In event of the premises being offered for sale, the occupier agrees to allow the owner or his agent to inspect the property with prospective purchasers during reasonable hours by appointment.
24. Please ensure you have your keys with you at all times. A cash fee of $50.00 will be charged on all lock outs and lost keys.
25. You are expected to leave the premises clean and tidy. Please ensure the refrigerator is left clean and empty, crockery and cutlery washed up and placed in cupboards/drawers, floors and bench tops to be left clean and all garbage wrapped and placed in the garbage bins provided. – Failure to comply with the above will result in an extra cleaning fee being made payable.
26. Where a security deposit is held no decision on the release of the deposit will be made until the property is checked by the cleaner and all the above is taken into consideration together with any damage (including carpet stains) and all linen is accounted for.
27. All occupants of the premises rented enter the premises at their own risk. The occupants are required to notify the agent of any item that requires repair or attention immediately.
28. All occupants are responsible for the safety of children at the premises and no responsibility is taken by the agent or owner for the safety of the children in the premises or on the balconies.
29. I, the said applicant, do solemnly and sincerely declare that all information provided to the agent is true and correct and that all the information was given of my own free will. I further consent to the lessor/agent contacting and/or conducting any enquiries and/or searches with the regard to the information and references supplied to the agent.
30. I understand and agree, should there be a requirement to commence proceedings for the recovery of rent, repairs and/or losses on the aforesaid property during the term or at the expiration of my booking, all costs associated with these proceedings shall be able to be recovered from me.
31. I further consent to the agent disclosing all personal information that they may hold for the purpose of commencing recovery action in relation to any debt owed as a result of outstanding rent, repairs and/or losses that occurs during my period of booking.
32. I, the said applicant do solemnly and sincerely declare that I am over 25 years of age and have read and understand the contents of this agreement and have the competence and capacity to enter and abide to the terms of the agreement.
33. I except that any monies paid towards this booking as acknowledgment of acceptance to all terms and conditions.
